Terms of Use
Terms of Use
Last updated October 23, 2026
These Terms of Use (“Terms”) are a binding agreement between you and the business that operates Listamos at listamos.ai (“Listamos,” “we,” “us”). They apply from the moment you create an account. If you do not agree, do not create an account and do not use the service.
1. Agreement
By creating an account — including by checking the box on the sign-up page or by continuing with Google, Apple, or Facebook after accepting these Terms — you agree to these Terms and to the Privacy Policy. If you use Listamos for a business, you represent that you have authority to bind that business, and “you” includes that business. The English text of these Terms controls if a translation differs.
2. Who may use Listamos
You must be at least 18 years old, or the age of majority where you live, whichever is higher. You may not use the service if you are barred from doing so under the laws that apply to you, or if we have previously terminated your account for a breach that is still unresolved.
3. The service
Listamos connects to marketplace shops you authorize, imports copies of listing data into your workspace, and sends back the changes you ask for. Bulk changes are previewed before they run, and a completed change can be undone where the product still has the prior values. We may add, change, or withdraw features. We do not promise a particular marketplace, channel, or AI model will remain available.
4. Your account
You must give accurate registration information and keep it current. You are responsible for the credentials, linked sign-in providers, and API tokens on the account, and for everything done with them. Tell us promptly through the contact form if you believe the account has been compromised. One person may own more than one workspace; a workspace with more than one member cannot be deleted until the other members are gone.
5. Your responsibilities
- Connect only shops and accounts you are allowed to manage.
- Comply with the terms, policies, and API rules of each marketplace you connect, including those of Etsy, Shopify, eBay, and Pinterest.
- Make sure that anything you upload, generate, or publish through Listamos is lawful and that you have the rights to use it.
- Review listing text, prices, images, and other output before it is published. Listamos applies the change you confirm; it does not check that the listing is correct, legal, or acceptable to the marketplace.
- Pay the fees for the plan you choose, and the taxes that apply to that purchase.
6. Acceptable use
You will not, and will not allow anyone else to:
- Use the service for unlawful, infringing, deceptive, or harmful content, including content you do not have the right to publish.
- Upload malware, or files meant to harm, overload, or gain access to the service or to anyone else’s account.
- Probe, scan, or breach the service, or reach another customer’s data.
- Scrape, resell, or build a competing product from the service, or reverse engineer it except where the law forbids that limit.
- Circumvent marketplace rate limits, access controls, or fees, or use Listamos to do so.
- Share your login, or use the service to send spam or to impersonate another person.
7. Marketplace connections
A shop is connected through that marketplace’s own authorization screen. Listamos does not receive your marketplace password. Access tokens are stored encrypted. You can disconnect a shop in Listamos or revoke access at the marketplace; we then delete the tokens and the imported listing copies for that shop. We are not the marketplace. Etsy, Shopify, eBay, Pinterest, and any other channel are independent services. We are not affiliated with, endorsed by, or certified by them unless we say so in writing. Their outages, policy changes, rejections, and removals of listings are their acts, not ours.
8. AI features
When you use an AI feature, the text, images, or other material you submit for that request are sent to the model provider that runs it, solely to produce the output you asked for. We do not use your content to train Listamos’s own models. Output can be wrong, incomplete, or similar to someone else’s material. You are responsible for reviewing it before it is published, and for the listing that results. We do not promise that output is accurate, original, non-infringing, or fit for a particular marketplace.
9. Plans, trials, and payment
Paid plans, trials, and what each plan includes are shown in the product before you subscribe. A new account includes a trial of the length shown in the product, and no card is required for it. When the trial ends without a card, the account is paused: everything in it is kept, but the workspace cannot be used until you subscribe. A card added during the trial keeps the plan, and that card is charged when the trial ends. Fees are charged by Stripe in the currency shown at checkout. Card numbers are collected by Stripe and are not stored on Listamos servers. You can change the card, switch plan, or cancel in the product. Cancellation takes effect at the end of the period already paid; the account is then paused until you subscribe again. If a payment fails, the account is paused until the invoice is paid. Fees are non-refundable except where the law requires a refund. Cancelling does not refund days already paid; a refund is only at our discretion, and a bank dispute of a charge ends access while it is open and keeps it ended if the dispute is lost. You are responsible for taxes on your purchase, other than taxes on our net income. We may change prices or plan limits on notice given in the product or by email before the change applies to a renewal. The current period is not repriced retroactively.
10. Intellectual property
Listamos and its software, design, and branding belong to us or our licensors. You keep ownership of your listings, shop content, and other materials you submit. You grant us a limited license to host, copy, process, display, and transmit that material only to operate the service, to apply the changes you request, and to prevent abuse. You also grant us the right to use feedback you send us without any duty to pay you for it. You may not use our name or marks except to say that you use the service.
11. Disclaimers
The service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted or error-free operation, or any business result, including sales, rankings, search placement, or that a marketplace will accept a listing. Marketplace APIs and AI providers can change, fail, or limit requests without notice.
12. Limitation of liability
To the fullest extent permitted by law, Listamos and its directors, employees, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption, however caused, even if advised of the possibility. Our total liability for all claims arising out of the service in any twelve-month period is limited to the greater of (a) the fees you paid us for the service in that period or (b) one hundred US dollars. These limits do not apply to liability that cannot legally be limited, including liability for fraud or for death or personal injury caused by negligence, and they do not limit your indemnity obligations below. The service would not be offered on these economic terms without these limits.
13. Indemnity
You will defend, indemnify, and hold harmless Listamos and its directors, employees, and suppliers from claims, damages, losses, and reasonable expenses (including attorneys’ fees) arising out of your content, your shops, your use of the service, or your breach of these Terms or of a marketplace’s rules. We may control the defense of a claim that is only against us, and you will cooperate. You will not settle a claim that admits fault by us or imposes an obligation on us without our written consent.
14. Suspension and ending
You may disconnect shops or delete a workspace you alone own, as described in the Privacy Policy. Deletion is irreversible. We may suspend or terminate access, and we may remove content stored for you, if you breach these Terms, if your use risks the service or other people, or if the law requires it. Where we can do so without increasing the risk, we will tell you the reason. Fees already paid are not refunded when we end access for your breach, except where the law requires a refund. Sections that by their nature should survive — including intellectual property, disclaimers, liability, indemnity, and governing law — survive.
15. Copyright complaints
If you believe material in the service infringes a copyright you own, use the contact form and include: your name and contact details; a description of the work; where the material is in the service; a statement that you have a good-faith belief the use is not authorized; a statement, under penalty of perjury where that standard applies, that the notice is accurate and that you are the owner or the owner’s agent; and your physical or electronic signature. We may remove the material and, for repeat infringement, suspend the account. If you believe a removal was a mistake, you may send a counter-notice with the same kind of detail.
16. Changes to these Terms
We may update these Terms. We will post the new version and change the “Last updated” date. If a change is material, we will also notify you by email or in the product before it applies. If you do not agree, stop using the service and delete the account before the change takes effect. Continuing to use the service after that date is acceptance of the new Terms.
17. General
These Terms, together with the Privacy Policy and the plan you subscribe to, are the entire agreement between you and Listamos about the service. They replace earlier agreements about the same subject. If a court holds a provision unenforceable, the rest remains in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor of the business. There are no third-party beneficiaries. Notices to you may be sent to the email on the account. Notices to us go through the contact form.
18. Governing law
These Terms are governed by the laws of the place where the operator of listamos.ai is established, without regard to conflict-of-law rules that would apply some other law. The courts of that place have exclusive jurisdiction, except that either party may seek interim or injunctive relief in any court that can grant it, and except where a mandatory consumer law in your country of residence does not allow this choice of court. Nothing in these Terms limits a right that the law says cannot be limited.
